A statement from the Institute

A dispute left undecidedis a loss that growsevery day.

SAMYA was founded on a plain conviction: that every dispute should be decided on its merits, by those who understand both its field and the law, within the time the Act prescribes, and without any party having to travel to be heard.

Why SAMYA exists

The gap SAMYA exists to close.

1

Arbitration was meant to be the faster path to resolve a dispute.

2

Every month a dispute stays undecided, its remedy loses value.

3

Too often it has been undone by loose administration, unproven notices, hurried records and awards that collapse on challenge.

SAMYA exists to close that gap. Every dispute is decided on its merits, by those who know its field and its law, within the time the Act allows, on a record as complete as a court’s.

The SAMYA distinction

A tribunal decides well only when it understands both the business and the law.

Specialist of the field

From banking, construction, insurance, technology, trade and other fields, who knows the practices and documents of that world.

Specialist of the judiciary

A retired judge or judicial officer, who holds the proceedings and the award to the Act and to natural justice.

An award secure in both its subject matter and its integrity under the Act.

The arbitration agreement

S. 7

Jurisdiction rests on a written agreement to arbitrate: a clause in the contract naming the Institute, or a submission agreement made after the dispute arises.

Check that your contract refers disputes to SAMYA. If it does not, the parties may still agree to refer this dispute.
